How Long After An Accident Do You Have To File A Claim?
According to the California Code of Civil Procedure section 335.1, the statute of limitations for personal injury cases in California is only two years. This means you have two years from the date of your car accident to file a claim or you may lose your right to pursue compensation.
If you are also seeking to recover compensation for damages to a vehicle the California Code of Civil Procedure section 338 explains that the statute of limitations changes from two years to three years from the date of the accident. In all cases it is important to speak to a lawyer about your case as soon as possible as the statute of limitations can be shorter or longer then the aformentioned time periods depending on the specifics of your case.
Who Can Bring A Car Accident Claim In California?
California follows the rule of pure comparative negligence. Under this rule, even drivers who are partially at fault for an accident may bring a claim against the other involved parties. When a judge or jury finds two or more drivers at fault for an accident, the total reward you may recover will be reduced by your percentage of fault—if you are 20% at fault, your recovery will be reduced by 20% of your total damages.
In addition to injured parties, the loved ones of catastrophically injured individuals and the surviving family members of those wrongfully killed may also bring claims against negligent and/or liable parties. Our firm can help you determine whether or not you have grounds for a car accident claim and, if so, will help you navigate every aspect of the legal process.
Should I Hire An Attorney For My Car Accident Claim?
Even if your accident seems minor it’s important to speak to an attorney after an accident! There are several reasons for this, a few of the main ones being:
- You may have suffered from more serious injuries than you realize. Some injuries don’t reveal themselves completely for a couple days, or sometimes, weeks after an injury is sustained.
- Filing a car accident claim can be complicated. If certain deadlines are not met, you may lose your right to recover compensation completely. Our firm can walk you through the claims process.
- Insurance companies are not on your side. They are a business that most often seeks to protect their bottom line first and foremost. Our firm on the other hand is dedicated to fighting for the maximum compensation you deserve.
We offer free, no obligation consultations, so you have nothing to lose. Contact Alpine Law Group today and learn how our Irvine car accident lawyers can help you.
